In Form einer kurzen Replik auf Einwände von William Scheuerman unternimmt der folgende Beitrag den Versuch, die Lösungen für drei miteinander zusammenhängende Probleme zumindest anzudeuten: Zunächst soll geklärt werden, welche Rolle dem »Recht« im Gesamt einer Analyse der gegenwärtigen, kapitalistischen Gesellschaften einzuräumen wäre; im anschließenden Schritt wird die Funktion thematisiert, die rechtlichen Belangen im Kampf um soziale Fortschritte gewöhnlich zukommt; und im letzten Schritt wird die schwierige Frage angegangen, welche normative Stellung dem »Recht« in einer übergreifenden Gerechtigkeitstheorie zukommen sollte.
The following contribution attempts, in the form of a brief rejoinder to objections raised by William Scheuerman, to at least hint at solutions for three intricate and intertwined problems of a critical theory of society: in a first step, it will clarify roughly which role the law should assume in the context of an analysis of contemporary capitalist societies; the following step will focus on the function that legal considerations fulfill within struggles for social progress; and the final step will pose the difficult question of how to delineate the normative role of the law within an overarching theory of justice.
