Katharina Pistor legt mit Der Code des Kapitals. Wie das Recht Reichtum und Ungleichheit schafft dem Rezensenten zufolge nichts weniger als eine »Krisentheorie des Rechts« vor. Adam Tooze ist beeindruckt von Pistors Analyse, die enthüllt, wie das Recht seit den ersten Landeinhegungen bis zum heutigen Derivatehandel Privateigentum sichert und hilft, Profite zu maximieren. Für eine wirksame Antwort auf den Rechtspopulismus greift jedoch die Darstellung des Staates, so der Autor, in Pistors politischem Programm zu kurz.
With her book The Code of Capital: How the Law Creates Wealth and Inequality, Katharina Pistor presents, in the reviewer†™s view, nothing less than a “crisis theory of law.† Adam Tooze is impressed by Pistor†™s analysis, which reveals how law, from the first land enclosures to the present-day trade in derivatives, secures private property and helps to maximize profit. However, Tooze argues, the representation of the state in Pistor†™s political program is not sufficiently radical to provide an effective response to right-wing populism.
