Entdifferenzierung der Rechtstheorie oder des Rechts?

Zusammenfassung: Die Autonomie des Rechts kann Luhmanns Theorie funktionaler Differenzierung zufolge erst behauptet werden, wenn das Rechtssystem in seiner Funktion und seiner selbstreferentiellen Geschlossenheit nicht durch äußere Einflüsse, etwa durch politische Macht, beeinträchtigt oder auf sie angewiesen ist. Diese Prämisse gerat bei naherem Hinsehen jedoch in gleich mehreren Dimensionen unter Druck: Bereits mit dem systemtheoretischen Fokus auf den Nationalstaat, der angesichts der These der funktionalen Differenzierung gerade im Falle der Kopplung des Rechts und der Politik einen noch immer erstaunlich hohen systematischen Stellenwert einnimmt, verliert die strenge Selbstreferentialitat des Rechts als Voraussetzung für die Systemautonomie so weit an Plausibilität, dass es schon schwierig wird, die Rechtsgeltung, -Begründung und -setzung von einer machtbasierten Durchdringung als frei gehalten zu behaupten. Spätestens wenn es dann um das Recht in der Weltgesellschaft geht, ist es, wie sich empirisch und theoretisch zeigen lasst, kaum mehr möglich, Recht nicht von Macht ableiten zu müssen. Es ist zu vermuten, dass die Durchdringung des Rechts von Macht in diesem Sinne weder rein begrifflich ?konstruiert?, noch bloß empirisch neutral ›beobachtbar‹ ist. Vielmehr ist anzunehmen, dass eine Theorie funktionaler Differenzierung noch zu einseitig ist, um die komplexe Differenzierung des Rechts der (Welt-)Gesellschaft angemessen zu beschreiben. Vor diesem Hintergrund kann die Autonomie des Rechts der Weltgesellschaft im Sinne der funktionalen Differenzierung erst wieder erfolgreich begründet werden, wenn man einerseits das mit der Systemtheorie erreichte Abstraktionsniveau als unhintergehbaren Masstab für die jüngere rechtssoziologische Theorie versteht und andererseits aber einsieht, dass die Theorie funktionaler Differenzierung revisions- und ergänzungsbedürftig ist, und dass man nur so weiter sinnvoll zwischen Recht und Macht unterscheiden

kann.

Abstract: According to Luhmann´s theory of functional differentiation the autonomy of law can only be claimed if the function and the self-referential coherence of the legal system are not affected by external factors, such as political power, or are dependent on them. However, on closer inspection, this assumption can come under pressure in multiple aspects: Already with the focus on the nation-state it becomes difficult to maintain the condition of self-referentiality of law which is supposed to establish its autonomy. Indeed, the notion of the nation-state has, in defiance of the theory of functional differentiation, still an amazingly strong systematic impact on systems theory, especially in the case of the coupling of law and politics. But as soon as the assertion of strict self-referentiality of law loses its plausibility and the coupling of law and politics becomes too bold instead, in theory it becomes hard to keep legal validity, its justification and legislation free from (political) power. At the latest, when it comes to the question of law in the global society, it is hardly possible not to deduce law from power. These objections can be demonstrated empirically and theoretically. It is likely that the penetration of law by power is neither purely conceptually ›designed‹, nor only empirically ›observable‹. Rather, it can be assumed that the theory of functional differentiation is too one-sided, and that one should also systematically consider equivalent but alternative forms of social differentiation in order to explain adequately complex forms of differentiation of law in global society. Against this background, the autonomy of law in global society can only be successfully constituted according to the theory of functional differentiation when one considers two things: on the one hand the systems theory has left us an enormous level of abstraction, which is doubtlessly uncircumventable. On the other hand, if one wants to avoid the necessity to deduce law from power in systems theory, the theory of functional differentiation is in need of correction and completion. Only this way one will be able to separate law properly from power.
